Boar's Head reaches $3.1m preliminary settlement in listeria lawsuit

Boar's Head Provisions Company Inc. has reached a preliminary settlement creating a $3.1 million fund in a class action lawsuit alleging the company failed to disclose potential Listeria monocytogenes contamination in its product labeling and marketing.
According to a preliminary approval order filed in the U.S. District Court for the Southern District of New York, Boar's Head and the plaintiffs have agreed to a settlement to resolve the claims with the lunchmeat producer. The lawsuit was filed on behalf of a nationwide class of consumers who purchased Boar's Head products before July 31, 2024.
According to the CDC, the outbreak resulted in 61 cases in 19 states, with 60 hospitalizations and ten deaths.
The lead plaintiffs alleged that Boar's Head engaged in deceptive practices by not informing consumers about the potential presence of Listeria, a bacterium that can cause serious infections, especially in vulnerable individuals. The complaint also criticized the company's recall process initiated in July 2024.
Boar's Head has agreed to a "Settlement Class" to resolve the case. The class includes anyone in the United States who purchased the recalled Boar's Head products for personal use and not for resale during the specified period.
The preliminary settlement, approved by Judge Philip M. Halpern, finds the agreement to be "fair, reasonable and adequate, and in the best interests of the Settlement Class," pending a final approval hearing scheduled for August 13, 2025.
The settlement agreement outlines a notification plan to inform class members of their rights, including the ability to file a claim, opt out of the settlement, or object to its terms.
Angeion Group has been appointed as the Claim Administrator to oversee the notification process and the distribution of benefits to eligible claimants.
The order explicitly states that the preliminary approval and the settlement terms do not constitute an admission of wrongdoing or liability by Boar's Head.
