A class action lawsuit has been filed after mass layoffs at two Trumbull County hospitals following "unforeseen circumstances" involving Steward Health's bankruptcy.

The lawsuit was filed by an employee at Hillside Rehabilitation Hospital who along with hundreds of others there and at Insight Hospital & Medical Center Trumbull was laid off without warning last week.

According to the lawsuit, Insight had originally told furloughed workers that they would still be on the payroll to receive accrued vacation time. However, employees were not paid for that vacation time, nor were they paid for three weeks' worth of wages.

Furthermore, all employees' health care benefits were terminated as of Monday, March 31.

According to the lawsuit, the WARN Act requires employees to receive a written notice 60 days in advance of being laid off. However, this did not happen.

"Based on information and belief, [Insight's] failure to give notice under the WARN Act is not excusable under any statutory exception to the WARN Act's Requirements," the suit reads.

Additionally, the WARN Act requires laid off employees to be paid their respective wages, salaries, commissions, bonuses, holiday pay and vacation pay for 60 days following their termination. According to the lawsuit, this too did not happen.

The employee who filed the suit is demanding Insight to pay employees what they are owed plus attorney fees.
