Editor's note: This story corrects the name of the Girard chief of police.

An internal investigation has two Girard Police officers on paid administration while determining whether or not officers performed an unlawful entry and search.

Girard Police Chief John Norman told 21 News that the two officers — Mark Crain and James Cerenelli — would remain on paid administrative leave while an investigation into whether the officers unlawfully entered a home without a warrant after an alleged domestic incident from an incident on September 7.

The incident report states police responded to the 500 block of Powers Avenue at 9:18 p.m. after a woman who had been at the house contacted police about the alleged incident. 

Officers responded to the scene, and the incident report states that Officer Crain knocked on the door at the home of 29-year-old Zachary Jones. The report states Crain witnessed Jones get up and shut off the light in the room.

The report states Crain told Jones to open the door, which the report states Jones acknowledged but ignored. 

Crain then forced entry into the home by kicking in the front door and ordering Jones out of the house at gunpoint. Jones was handcuffed by Cerenelli on the porch and placed into the patrol car.

Cerenelli then transported Jones to the Girard Police Department for booking. 

The report then states that Crain seized a handgun from Jones' bedroom that was found in a shoebox.

Jones told 21 News he filed a complaint alleging a violation of his 4th amendment rights from what he alleges was an unlawful search without a warrant at his house.

Jones also filed a complaint with police due to alleged injuries to his wrists.

Jones was found guilty in Girard Court on October 10 of assault and disorderly conduct and sentenced to 60 days of house arrest and ordered to pay fines and court costs.  He is also to be assessed for anger management and/or a mental health assessment, along with an assessment of drug and/or alcohol abuse. 

The officers will remain on paid leave until the internal investigation is complete.
