Appeal filed following court approval of $600 million settlement for East Palestine derailment
In the days following the approval of a $600 million class action settlement for residents affected by the East Palestine train derailment, a notice of appeal has been filed for the judge's ruling.
According to a press release, class member Joseph Sheely filed a notice of appeal to the United States Sixth District Court of Appeals.
Because of this, those who opted in to the settlement will have to wait for a resolution to the appeal, which could take up to two years.
"Sheely and his attorney had an opportunity to opt out of the settlement and file their own lawsuit. Instead, their approach of objecting and filing an appeal will stop payments for the tens of thousands of people who are awaiting their claims to be paid," the release reads.
A statement from the court appointed class counsel for the settlement expresses disappointment in the appeal. The statement reads as follows:
"We are deeply disappointed by this appeal, which will prevent the swift payment of direct household and business loss claims to this community which voted overwhelmingly in support of the settlement."
"We will do everything in our power to quickly resolve this appeal and prevent any further burdens on the residents and local businesses that want to move forward and rebuild their lives. It is tragic that one person is substituting their judgment for the entire community who wants this settlement, and instead of opting out they have gone this route."
"But ultimately, only the objector who appealed can decide whether he should continue making arguments that have been rejected by the District Court, and now delay recovery and further burden this community which was counting on the settlement's benefits to be delivered swiftly."
The approval of the settlement garnered negative reactions from some in the community with some saying they felt like they were "duped" and "bullied" into opting in to the settlement.
Others expressed frustration that residents of East Palestine and its surrounding communities were not given an opportunity to speak in the courtroom and give their thoughts.
