An officer with the Brookfield Police Department has been cleared of any wrongdoing after a video surfaced and a lawsuit was filed regarding an incident in which a woman was pushed into her cell and sustained serious injuries.

According to a press release, the video in question was taken in November of 2023 when a woman identified as Jennifer Miller was being arrested for OVI.

In her complaint, Miller said she was thrown to the ground in a "martial arts style throw" by Brookfield police officer Cody Dean, which knocked her out. The suit claimed Miller was not armed and posed no threat to officers.

The lawsuit claims Brookfield Township failed to adequately train or supervise its officers regarding proper arrest procedures and the use of physical force.

According to the filing, Miller suffered substantial physical pain, loss of daily function, emotional distress and costs including legal and medical treatment fees.
 
According to the release, after an investigation, which consisted of interviews and viewing the video from multiple angles, it was determined that factors including Miller's intoxicated state, resistance to enter the cell, her footwear and a one-handed pull and push to get her inside the cell all contributed to her falling to the floor.
 
Police say while Miller did sustain injuries, officer Dean sought medical treatment for her immediately and there was no intentional act of harm done to her.
 
"The incident was a terrible accident and internal changes have already been implemented with regards to prisoner handling to prevent any further types of injuries of this kind in the future," said Brookfield Police Chief Aaron Kasiewicz. 
 
The matter is now pending civil litigation and police are not commenting any further at this time.
