A settlement in the lawsuit between Lordstown Construction Recovery LLC and neighbors who complained of dust and odors drifting onto surrounding properties has been deemed fair in federal court Friday.

Attorneys in the courtroom Friday afternoon say notice programs on the $1.2 million settlement had been sent out on March 14. Eight people had dropped out of the settlement for "unknown reasons," but there has been "unanimous approval" of the settlement.

Attorneys representing the neighbors say they had been "overwhelmed" with calls grateful for the settlement.

Attorneys say the settlement only releases claims during the class period and no future claims will be released.

No specific date has been set for payment, but settlement will be effective 30 days after the final order.

The suit against the Lafarge landfill alleged that the landfill releases noxious odors and dust that drifts to her property, causing damage and hurting property values.

Among the landfill gases allegedly emitted included rotten-egg smelling hydrogen sulfide, methane, and carbon dioxide which are byproducts of decomposition.
 
The complaint also included complaints from owners of three other properties near the landfill describing the odor as “skunk-like”, saying the dust forces them inside their homes and closing the windows.
