The Trumbull County Prosecutor's Office has released its final findings in its investigation into a deadly officer-involved shooting in Hubbard Township back in October of 2023.

According to the report, the Prosecutor's Office found that the deadly shooting of 55-year-old Shawn Thomas during an incident on Hubbard-Masury Road the night of October 3, 2023 was justified.

Prosecutors say Thomas had two shotguns on him at the time of the shooting and one of them was pointed in the direction of the officers posing an immediate threat to them.

"Every statement and action of Thomas would have been interpreted by a reasonable officer on the scene that Thomas was equipped with two loaded shotguns and would use them," the report reads.

The incident stemmed from an argument that night between Thomas and his wife. Thomas's wife told police that her husband had went into a wooded area with a shotgun.

According to the Prosecutor's Office, Thomas was intoxicated and was assaulting his wife by choking her and threatening to kill her. Prosecutors say at one point Thomas was heard saying there were "shotguns all around the house" and he was "not going back to jail."

Shortly after 10:30 p.m., it was reported that shots had been fired. One neighbor told 21 News he heard someone saying "put the gun down" followed by two shots being fired.

Prosecutors say when Thomas was ordered to put the gun down, he put one down, but then drew the second shotgun with his right hand on the trigger pointing it at officers.

That's when two officers fired at Thomas who later succumbed to his injuries.

Officers from both Hubbard City and Township, Liberty Township, Brookfield Township and Vienna Township Police Departments, as well as the Ohio State Highway Patrol (OSP) and Trumbull County Sheriff's Office responded to the scene.

None of the officers or Thomas's wife sustained any injuries during the incident.
