MS Consultants Inc., an engineering and architecture firm that worked with the MJ Joseph Development Company on the Youngstown Chill Can plant, has filed a foreclosure complaint in Mahoning County Common Pleas Court Wednesday against the California-based company for money owed to the firm.

According to the filing, MS Consultants filed a foreclosure complaint over the Chill Can plant site, citing a previous judgment awarded to the firm against the Joseph company for $322,907.54.

MS Consultants is seeking payment of the debt through the sale of the East Side facility and its property. 

The complaint asks the court to order the parcels to be appraised and sold, so the proceeds could go towards the debts owed to MS Consultants and the City of Youngstown, which also won a judgment against the company.

The complaint also that the MJ Joseph company should be required to state its interest in the property or be barred from any claims to the parcels moving forward after a reasonable amount of time to be determined by the court.

In late 2022, a magistrate ordered the developer of Youngstown’s unfinished Chill Can project to refund $1.5 million to the city.

The project was slated to create more than 230 jobs at the plant in Youngstown that would manufacture self-chilling beverage cans.

The Joseph Company broke ground in late 2016 for the plant on a ten-acre site on the East Side.
