The accused gunman in the death of four year old Rowan Sweeney last September appeared before Mahoning County Common Pleas judge Anthony D'Apolito Monday.
 
Kimonie Bryant's lawyers had recently asked the judge to dismiss a charge of conspiracy, saying prosecutors didn't try him soon enough from when they charged him. Monday, both they and the prosecution agreed that they needed more time to exchange information about the witnesses and evidence.
 
"Our motion today is to ask the court to put that off until after we get bill of particulars and then we'll subpoena those witnesses that we had subpoenaed for today and if need be any additional witnesses," said defense attorney John Juhasz.
 
"The bill of particulars, the hearing itself, all goes hand in hand with discovery," said deputy prosecutor Michael Yacovone. "Discovery being provided, reviewed, and both sides having an adequate opportunity to be prepared for said hearing."
 
D'Apolito instead delayed the motion to dismiss the conspiracy count.
 
That delay means Bryant's trial - which was slated for September - will now begin in early 2022.
 
A date will be set at his next pre-trial hearing September 30.
 
Bryant is one of three people charged with aggravated murder in connection to Sweeney's death during a home invasion in Struthers.
 
The second, Brandon Crump, was set to go to trial in January.
 
That's also now been delayed because of Bryant's trial delay.
 
The third, Andre McCoy who almost didn't survive his injuries from that home invasion, is wanted by US Marshals.
 
Meanwhile, Sweeney's mother Alexis Schneider, who suffered gunshot wounds in that same home invasion, faced indictment earlier this year on gun charges.
 

We've learned she pleaded guilty and agreed to probation, drug and alcohol testing, and counseling.
