A judge has ordered the operator of an addiction recovery facility in Austintown to vacate the faux palm-tree landscaped former hotel it now occupies at Route 46 and Interstate 80.

Mahoning County Magistrate Dominic DeLaurentis issued a finding Wednesday finding the California Palms Addiction Recovery Center and owner Sebastian Rucci in contempt of an earlier court-approved settlement with a lender, Pender Capital.

Rucci told 21 News last week that he expected to secure re-financing on the $4 million debt.

The magistrate found that Rucci and California Palms failed to fully cooperate in providing complete and accurate financial information related to the property and continued admitting patients in following the default.

According to the finding, Rucci defaulted on the May agreement, and the magistrate has been given California Palms until December 4 to vacate the former hotel, and must not admit any new patients.

Rucci has been ordered to work with the Ohio Department of Mental Health and Addiction Services to relocate existing patients.

The judgment also orders Rucci to pay the lender more than $77,000 in legal costs.

In the meantime, Rucci is being permitted to pursue re-financing and could still appeal the judgment.

California Palms Recovery has been operating as a rehabilitation campus for the past twenty-nine months.

Formerly the Hotel California as guest lodgings, Rucci changed the name to California Palms Hotels and Suites after trademark issues arose.

Saying that he faced competition from nearby hotels with loyalty awards, Rucci announced in early 2017 that he planned to turn the facility into a rehab and recovery center.
