Synthetic pot raid in Niles

A raid at a Niles convenience store nets about 1,200 packets of synthetic marijuana.
Niles Police Captain Ken Criswell says the items they seized, under brand names such as Super Nova, Up Cake Energy Brownie and Barely Legal, are illegal.
They were confiscated from the Red Dragons Convenient Food Mart at 505 North Main Street in Niles.
Police also confiscated 100 smoking devices as well.
Captain Criswell tells 21 News the smoking pipes or bongs are not illegal unless illegal substances are being sold at the same place or there is residue of an illegal substance inside.
Kriswell explains synthetic marijuana is marketed as herbal incense. They can be made from herbs then sprayed with chemicals that can produce a high.
Symptoms of smoking synthetic marijuana can include euphoria, excessive sweating, inability to speak, and aggressive behavior. The effects appear to last a short time, but researchers say they don't know if the products can cause long term damage.
No criminal charges have been filed, but police say they are consulting with the prosecutor's office.
Attorney Devon Stanley says no one informed the store owner the products were now illegal. The attorney states the brochures provided to the store say the product is legal and clerks only sold to persons 21 years of age or older.
Trafficking charges could be brought against the owner of the store. In addition police say any charges could be increased due to the proximity of McKinley High School just 4/10ths of a mile away.
This should serve as a cautionary tale for stores still selling Caution and other brands of synthetic marijuana that became illegal last October in Ohio. Captain Ken Criswell says convenient stores should be in the business of selling legal products, not pseudo drugs and smoking devices.
The Ohio Department of Liquor Control was on the raid along with the Bureau of Investigations and Identification, and Niles police.
We're told the store could now have an issue with its liquor license.
