This was based on a misreading of the grand jury report, which listed both the misdemeanor and felony counts separately. An Austintown man accused of sexual assault has been partially dismissed by a Trumbull county grand jury .

Ryan Gregory, 33, had been accused of gross sexual imposition and public indecency in Niles municipal court stemming from an incident in December. 

On Thursday, the Trumbull county grand jury issued a no-bill for the sexual imposition charge, meaning they declined to indict him on the matter. A misdemeanor charge of public indecency was ordered back to Niles municipal court .

Gregory had been accused of attempting to bite a woman's ear, which was the basis for the now-dismissed charge. An additional misdemeanor charge of sexual imposition was also sent back to the lower court .

Police say the alleged victim pushed him away, but he came back with his genitals exposed.
