Judge orders objectors to $600M East Palestine derailment settlement to post $850,000 bond
Five East Palestine area residents opposed to the court-approved $600 million settlement in the East Palestine Derailment class action lawsuit will have to post $170,000 bonds each if they wish to continue their appeals in court.
U.S. District Court Judge Benita Pearson on Thursday issued an order on the appeals filed by Rev. Joseph Sheely Zsuzsa Troyan, Tamara Freeze, Sharon Lynch, and Carly Tunno.
The court order requires the objecting class members to post a total bond of $850,000 to cover the costs of the appeal.
The order goes on to say that if any five objectors withdraw their appeal, those remaining will be responsible for the entire $850,000 bond amount.
Judge Pearson found that the objectors were likely to lose their appeal and that the appeal would delay the distribution of settlement funds to the class members who supported the settlement.
Attorneys objecting to the appeals argued that those who opted into the settlement would have to wait for a resolution to the appeal, which could take up to two years.
