A Hubbard man is suing the city of Campbell and  two officers with the Campbell Police Department claiming they used excessive force during an encounter with him.

According to the suit, officer Jacob Xenakis and sergeant Timothy Rauschenbach are being sued by Francis Fasline of Hubbard for alleged excessive force during an encounter back in December of 2023.

According to the suit, the alleged incident happened on the 600 Block of Dumont Avenue when police received a call about a "suspicious person" in the area.

The suit alleges that sergeant Rauschenbach approached Fasline, ordered him to get on the ground and forced him to the ground when he did not immediately comply.

The suit goes on to allege that while Rauschenbach was on top of Fasline, Xenakis deployed the department's K9 who bit Fasline on the thigh before the K9 was removed.

According to the suit, Fasline began to comply following this, but Xenakis once again deployed the K9, who this time attacked Fasline's arm for over a minute while the officers told him to put his hands behind his back.

The suit alleges that Fasline begged the officers to remove the K9 from his arm, but they refused to do so.

The suit described Xenakis's refusal to call the K9 off of Fasline as "excessive, unnecessary and malicious" and further alleges that Xenakis has a history of excessive K9 deployment and alleges that both officers felt negatively towards Fasline due to previous interactions with him.

According to the suit, Fasline has not been able to work due to the injuries he had sustained from this incident.

Fasline is demanding compensatory damages of over $75,000 plus court costs, interest and attorney fees.

21 News has reached out to the Campbell Police Department for comment on this suit and we're waiting to hear back.
