The father of a local soldier who was killed in Iraq testified before a congressional subcommittee investigating whether a Kuwaiti company was negligent in his death.

Lietenant colonel Dominic "Rocky" Baragona was killed when his Humvee was hit by an out-of-control tractor-trailer from the Kuwaiti and Gulf Link Transport Company, which had been contracted by the United States government for work in the area.

His father, Dominic Baragona, said his son's death was not investigated until the family pursued the issue.

"The report, which had been approved by General Sanchez, was terrible. For one thing, it had no info on the driver or the name of the company. It gave a false impression of how Rocky had died," Baragona said.

A wrongful death settlement of nearly $5 million the family won in 2005 was thrown out by a federal judge because the court had no jurisdiction over the company.

Both the Senate and House of Representatives are considering bills that would hold contractors accountable in the event of accidents like the one that Baragona was killed in.
